Terms of Service

These terms explain how Formserve works, how billing and retention behave, and what you are responsible for when using the service.

Formserve is owned and operated by JOHO DIGITAL FZE, B.C 1308805, Business District, Ajman Free Zone, United Arab Emirates. By using Formserve ("Service"), you agree to these Terms of Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

1. Account terms

  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activity that occurs under your account, including actions taken by invited team members.
  • You must provide accurate account information, including a valid email address.
  • Accounts that remain unverified, have no active resources, and show no retained usage may be removed automatically after 30 days as part of our security and abuse-prevention process.
  • You may not use the Service for illegal activity, abuse, fraud, spam, or to violate any applicable law.
  • Accounts created by bots or by automated means without authorization are not permitted.

2. Service use and acceptable use

  • You may not probe, scan, reverse engineer, disrupt, or attempt to bypass Service limits, security controls, or access restrictions.
  • You may not use the Service to upload or distribute unlawful, harmful, infringing, or malicious content.
  • We may suspend or restrict access if we reasonably believe your use creates a security, legal, operational, or abuse risk.
  • We may enforce plan limits, rate limits, retention limits, and anti-spam controls at any time.

3. API, integrations, and third-party services

  • Use of the API, webhooks, and integrations is governed by these Terms and any applicable documentation or usage limits shown in the product.
  • Integrations may depend on third-party services such as Stripe, email providers, storage providers, analytics tools, and workflow destinations.
  • We are not responsible for outages, failures, data loss, or policy changes caused by third-party services outside our control.
  • You are responsible for keeping integration credentials, webhook URLs, and connected services secure.

4. Plans, billing, renewals, and cancellation

  • Paid plans are billed through our payment provider on a recurring basis unless canceled.
  • Plan prices, limits, and included features are shown on the Service and may change with notice.
  • Upgrades may be prorated where the billing system supports it. Downgrades generally take effect at the end of the current billing period.
  • You can manage or cancel your subscription from the billing area in the app. Cancellation stops future renewals, but you keep access until the current billing period ends unless we state otherwise.
  • Unless required by law or expressly stated otherwise, fees are non-refundable.
  • If you stop using the Service, canceling your billing relationship does not automatically delete your account data unless you also request deletion or your plan and retention rules require deletion.

5. Data retention, deletion, and exports

  • Submission data is retained according to your active plan's retention period unless a different period is shown in your account or agreed in writing.
  • When a retention period expires, Formserve may send advance warning emails before deletion and then remove the data automatically.
  • Data beyond a plan limit may become inaccessible when your plan changes or your account is canceled, and may be deleted after the applicable retention or grace period.
  • You are responsible for exporting data you want to keep before a retention window expires.
  • We may retain certain records as needed for billing, security, fraud prevention, legal compliance, and dispute resolution.

6. Team access and workspaces

  • If your plan includes team members or client workspaces, you are responsible for granting the correct access to the correct endpoints.
  • Team members act on your behalf, and you are responsible for their actions within the access you grant.
  • You must not share credentials to avoid plan limits or use team access in a way that circumvents subscription restrictions.

7. Content ownership

  • You retain ownership of content you submit to the Service, including form data and uploaded files, subject to the rights you grant us to store, process, and transmit that content to operate the Service.
  • We do not claim ownership of your form submissions or your uploaded files.
  • You are responsible for ensuring that your own forms, notices, and data practices comply with applicable law.

8. Service changes

  • We may modify, suspend, or discontinue any part of the Service at any time.
  • We may update pricing, features, limits, or technical requirements. When we do, we may post the change on the Service or notify you by email or in-app notice.

9. Warranty disclaimer and liability

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee the Service will be uninterrupted, error-free, or suitable for every use case.
  • To the maximum extent permitted by law, Formserve will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Termination

  • You may stop using the Service at any time and cancel your subscription through the billing area.
  • We may suspend or terminate access if you violate these Terms, abuse the Service, or create legal or security risk for us or other users.

11. Changes to these terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the effective date. Your continued use of the Service after a change becomes effective means you accept the updated Terms.
